WeStayPH (the “Company,” “we,” “us,” or “our”) provides an online platform for users to list, discover, and book short-term accommodations within the Philippines. Our Platform connects hosts (“Hosts”) who have accommodations to rent with guests (“Guests”) seeking to book such accommodations.

2. User Responsibilities

Eligibility

To use our Platform, you must be at least 18 years old and capable of entering into legally binding contracts. By using WeStayPH, you confirm that you meet these requirements.

Account Registration

Users must register an account to access certain features on the Platform. You are responsible for all activity that occurs under your account, and you must maintain the confidentiality of your login credentials. Any suspected unauthorized use of your account should be reported to us immediately.

3. Host and Guest Obligations

Host Obligations

As a Host, you are responsible for accurately describing your accommodation, ensuring it is safe, and complying with all applicable laws and regulations. You agree that:

  • You are solely responsible for the content and accuracy of your listings.
  • You will not misrepresent any aspect of your accommodation or its amenities.
  • You will maintain the cleanliness, safety, and readiness of the accommodation as described.

Guest Obligations

As a Guest, you agree to treat the accommodation with respect and comply with the terms set by the Host. This includes:

  • Adhering to check-in and check-out times.
  • Keeping the property clean and in good condition.
  • Not causing any nuisance or engaging in illegal activities.

4. Booking and Payment Terms

Booking Process

When a Guest requests to book an accommodation, they must provide payment information to secure the booking. The booking will be confirmed only when the Host accepts the request.

Payments and Fees

Guests are responsible for paying the accommodation fee, which includes any applicable service fees and taxes. Hosts will receive payment for confirmed bookings minus any applicable fees.

Cancellation Policy

Both Hosts and Guests are subject to our cancellation policies. Guests may cancel a booking according to the Host’s cancellation policy, and any refunds will be processed according to that policy. Hosts may not cancel bookings except in emergency situations.

5. Taxes

Hosts and Guests are responsible for determining and fulfilling their tax obligations arising from using the Platform. WeStayPH may provide tax-related information as a courtesy but does not offer tax advice.

6. Content and Intellectual Property

All content uploaded to the Platform, including text, images, and reviews, must comply with our Content Guidelines. By uploading content, you grant WeStayPH a non-exclusive, worldwide, royalty-free license to use, modify, and distribute the content as needed.

7. Prohibited Activities

Users may not:

  • Use the Platform for any illegal or unauthorized purposes.
  • Misrepresent themselves or their intentions.
  • Engage in abusive behavior or harass other users.
  • Post false, misleading, or offensive content.

8. Limitation of Liability

WeStayPH is not responsible for any damages arising from your use of the Platform, including but not limited to issues related to accommodations, cancellations, or disputes between users. By using the Platform, you agree that WeStayPH’s total liability is limited to the amount you paid for the transaction in question.

9. Dispute Resolution

Any disputes between users (Hosts and Guests) should be resolved directly. WeStayPH may, at its discretion, offer limited assistance in dispute resolution but is not responsible for resolving disputes.

10. Modifications to These Terms

WeStayPH may update these Terms at any time. We will provide notice of changes through the Platform. Your continued use of the Platform following any changes signifies your acceptance of the revised Terms.
